Privacy Policy – "Kreeda" This Privacy Policy (hereinafter: the "Privacy Policy") constitutes an integral part of the Terms of Use of the "Kreeda" platform and should be read together with the Terms of Use, and the definitions therein shall apply. The Operator, [Kreeda legal entity name], Company No. [registration number] (hereinafter: the "Operator" and/or "Kreeda"), is committed to respecting the privacy of the users of the website and the application. In order to enhance the protection of user privacy, the Operator publishes this Privacy Policy and provides the information contained herein regarding the options available to the user during use of the platform and regarding the Operator's practices concerning the collection of information in connection with the use of the service. General As part of using the services of the website and/or the application, the user will be asked to provide personal details to the Operator, including, among others, full name, phone number, email address, location (optional), preferred courts (optional), and additional profile details, which are intended for the purposes of registering for the service, creating a user account, providing access to the personal area, reserving and booking padel courts, registering for tournaments, coordinating matches, finding players, calculating the player's rating, managing the digital wallet and credits, and providing access to the personal area. This information will be stored and processed for operational, internal, and service purposes, including for the purpose of providing the service, contacting the user, support, improving the service, calculating player ratings, managing the digital wallet, processing credit transactions, managing the referral program, and future communication with the user. The information is collected through the website and/or the application and may also be stored and processed in certain external systems. Payment method details, if requested in the context of court reservations, tournament registrations, and/or product purchases, are required solely for the purpose of completing the payment and are not fully stored by the Operator, but rather as an encrypted Token with the payment processor, unless explicitly stated otherwise. During use of the website and/or the application, data may accumulate regarding the user's manner of using the service. The information collected may include, among others, activity and usage patterns, court reservation history, tournament registrations, match results, player rating, credit balance in the digital wallet, credit transaction history (accrual and usage), referral program activity, dates and duration of use, pages and screens viewed by the user, actions performed, IP address, device identifier, operating system type, browser type, technical usage data, location data (if consent was given), usage preferences, and usage habits. This information is used, among others, for operational, statistical, research, marketing, and advertising purposes, for improving the service, calculating player ratings, matching players, managing the digital wallet and referral program, and recommending courts, and in its substantial part does not personally identify the user. The website and the application operate, among others, using Artificial Intelligence (AI) technologies and language models (LLM). In the course of the user's interaction with the service, and for the purpose of calculating the player's rating using an algorithm based on wins, winning streaks, who the player defeated, and additional parameters, providing recommendations for courts, matching players, generating insights, statistical analyses, and improving the user experience, the system collects, stores, and records information that the user voluntarily provides during the use of the service. This information may include, among others, details about the user, match history and results, wins and losses, information entered when creating a profile, preferred courts, location (if the user granted permission), player rating, players against whom the user played, tournaments in which the user participated, usage preferences, correspondence in chats and communities, correspondence with the Operator, correspondence with court owners and other users, and any other personal detail that the user chooses to enter or upload to the system on their own initiative. In addition, during use of the website and/or the application, additional technical and operational information may accumulate, including usage patterns, access times, actions performed, products and/or content in which the user was interested, IP address, device type, device identifiers, browser type, and additional system data. This information is used for the Operator's operational purposes, including for the purpose of routine operation of the service, security, error prevention, improving the user experience, and improving the performance of the website and/or the application, and in its substantial part does not personally identify the user. The use of the system is intended for the purpose of reserving and booking padel courts, registering for tournaments, coordinating matches, finding players, calculating a personal rating, receiving statistical analyses and general recommendations, and for the purpose of using ancillary services provided by the Operator within the website and/or the application, including chats and communities. It is hereby clarified that the ratings, analyses, insights, and recommendations presented within the service are based, among others, on technological means and artificial intelligence mechanisms, and are provided for informational, personal tracking, and illustrative purposes only and do not constitute a professional or official sporting evaluation. Users should not upload to the service any discrete, intimate, medical, biometric, financial, or other sensitive or confidential information, unless explicitly required for the operation of the service. The system is not intended for the preservation of secrets or sensitive information, and the user should exercise judgment when uploading content to the service. It shall be clarified that all information, content, match history, and any other information or detail uploaded to the system by the user, including match results, ratings, correspondence in chats and communities, may be documented, stored, and processed by the Operator and/or by its service providers, including technology and artificial intelligence providers, for the purpose of providing the service, calculating player ratings, matching players, monitoring, maintenance, security, and improving the service. The user acknowledges that they are aware that the content they upload to the system may be accessible to the Operator and to said providers for these purposes. Database and Its Use The data collected about the user as specified above is stored in the Operator's database. The Operator undertakes to use said information in accordance with this Privacy Policy and/or in accordance with the provisions of any applicable law and for the following purposes: Providing the service: creating and managing the user's account, reserving and booking padel courts, registering for tournaments, coordinating matches, finding players at a similar level, calculating the player's rating using an AI-based algorithm, displaying match history and results, managing the user's digital wallet, processing credit transactions, managing the referral program, providing personalized recommendations for courts and players, displaying personal information to the user, providing access to chats and communities, and providing support services; Improving the service and models: using information, content, match history, results, usage data, and interaction data for the purpose of operating the service, improving the user experience, improving the accuracy, quality, and performance of the algorithms (including the player rating algorithm), models, and systems of the Operator and/or its service providers, all subject to applicable law; Documentation, monitoring, and security: maintaining usage history, data, content, match results, ratings, credit transactions, referral program activity, and history uploaded to the system, for documentation, security, fraud prevention, prevention of manipulation of the rating system, prevention of abuse of the digital wallet or referral program, monitoring, control, troubleshooting, and improving the service and user experience; Statistics and analysis: processing, analyzing, and providing statistical, aggregate, or anonymous information that does not personally identify the user to third parties, including for business, research, operational, and marketing purposes; Enforcing the Operator's Terms of Use, preventing prohibited use of the service, and protecting the Operator's legal and contractual rights; For any other purpose specified in the Terms of Use, in this Privacy Policy, and/or as required by any applicable law. Digital wallet and credits: within the service, a digital wallet is operated that allows the user to manage credits and use them for payment for services on the platform. The Operator collects and stores the following information regarding the user's digital wallet: The user's current credit balance; Credit transaction history, including dates, amounts, source of accrual (refund, referral program, promotions, etc.) and type of usage (payment for court reservation, tournament registration, etc.); Activity within the referral program, including unique referral links, referral codes, number of new users who registered through the user, credits received within the program, and crediting dates; Credit validity (where relevant within certain promotions); Any additional information required for the proper management of the digital wallet and transaction processing. This information is stored in the Operator's database and is used for the following purposes: managing and processing transactions, tracking credit balances, crediting and debiting the wallet, managing the referral program, preventing abuse or fraud, improving the service, user support, statistical analyses, and personalized offers. Use of Information and Direct Marketing User details provided by the user will be subject to the Operator's Privacy Policy, and the user confirms that the information provided by them and/or collected about them will be stored in the Operator's database for the following purposes: Marketing, advertising, sales promotion, and contacting the user in any manner permitted by law, including by direct mailing and various communication means, in connection with the Operator's services, padel courts, tournaments, updates, benefits, promotions, innovations, professional padel content, and additional content that may interest the user; Encouraging loyalty, statistical analysis and research, conducting surveys, examining user preferences, adapting services, products, and content to users, and any other use in connection with registration for the service and its use; Internal, service, and operational purposes, such as handling inquiries, addressing complaints, responding to user requests, monitoring, internal enforcement, risk management, and troubleshooting; Operational, marketing, research, and statistical purposes, including processing, analyzing, segmenting information, and sending direct mail subject to the user's consent and in accordance with applicable law; Providing services to the user, managing the relationship with them, completing actions they requested, and ensuring proper, fair, and lawful operation of the service. The user acknowledges that they are not under any legal obligation to provide the information, and its provision is made of their own free will and with their consent. However, the provision of certain information may be required for registration, use of certain services, court reservations, tournament registrations, match coordination, rating calculation, use of the digital wallet and credits, participation in the referral program, access to chats and communities, and/or completing purchases. Furthermore, the Operator shall be entitled, for the purposes listed above and subject to applicable law, to transfer from time to time unidentified, anonymous, or aggregate information regarding user activity within the website and/or application, including statistical data on use of the digital wallet and referral program, to entities partnering with the Operator, to court owners, to service providers, to advisors, and to any entity providing the Operator with services related to the operation of the service. In accordance with the user's lawful consent, the Operator shall be entitled to contact the user from time to time by direct mailing for the purpose of receiving offers, tournament updates, event invitations, court promotions, padel-related content, benefits, and information in connection with the Operator's services, products, and activities, by email, SMS, push notifications, social networks, and/or by phone, as long as no refusal or removal notice has been received from the user, in accordance with applicable law. Disclosure of Information to Third Parties The following are situations in which the Operator may share the user's information with third parties: Within the management of the digital wallet and processing of credit transactions, the Operator may transfer relevant information to payment processors, payment service providers, information security providers, and cloud providers, as necessary for the operation of the wallet, transaction processing, system security, and fraud prevention. To service providers, subcontractors, cloud providers, infrastructure providers, payment processors, mailing service providers, support providers, information security providers, data analysis providers, technology and artificial intelligence providers, and to padel court owners, as necessary for operating the service, providing the service, and improving it, including for the purpose of transferring booking details, confirming bookings, payments, and tournament registrations; When the user has authorized the Operator to transfer their personal details to third parties, or has requested the Operator to perform an action involving the transfer of said information; In the event that the user violates the Terms of Use of the website or attempts to perform actions contrary to law; In order to enforce the Terms of Use or other agreements or policies; In response to a subpoena or other investigative demand, court order, or request for cooperation from a law enforcement or other governmental authority; In order to establish or exercise the Operator's legal rights; In order to defend against legal claims as may be required by law. In such cases, the Operator may raise or waive any objection or right available to it, at its sole discretion; When the Operator believes that disclosure is appropriate in connection with efforts to investigate, prevent, report, or take other action regarding illegal activity, suspected fraud, or other wrongdoing; In order to protect the rights, property, or safety of the Operator, its employees, users of the website, or others; In connection with a material corporate transaction, such as a sale of the Operator's business, divestiture, merger, consolidation, or asset sale, or in the event of liquidation. Aggregate and Non-Personal Information The Operator may use aggregate and non-personal information that it has collected in any of the circumstances stated above. The Operator may combine non-personal information it has collected with additional non-personal information collected from other sources. Furthermore, the Operator may share aggregate information with third parties, including advisors, advertisers, and investors, for the purpose of conducting general business analysis. For example, the Operator may report to its advertisers about the number of website users, the most viewed products, and more. Such information does not include any personal information and may be used to develop content and services that will assist the user and to customize content and advertising. Third Parties; Use of Artificial Intelligence In the course of using the website and for the purpose of generating visualizations through the system at the user's request, there are several places on the website where the user can click on a link to access links to websites that are not subject to this Privacy Policy and are not affiliated with the Operator. These links may request from the user and/or independently collect information about them, including personal information, and in certain cases provide the Operator with information about the user's activity on those links. Any third party to which the Operator may disclose personal information subject to this Privacy Policy may have its own privacy policy describing how it uses and discloses personal information. Such policy shall govern the use, handling, and disclosure of the user's personal information after the Operator has shared it with said third parties as described in this Privacy Policy. The Operator may allow third parties, including its authorized service providers, vendors, advertising companies, and advertising networks, to display advertisements on the website and/or in the application. These entities may use tracking technologies, such as Cookies, SDKs, pixels, unique identifiers, and similar means, in order to collect information about users who view or interact with the content, service, or advertisements. The use made by such third parties of these technologies is subject to their own privacy policies and not to the Operator's Privacy Policy. The service is based, among others, on artificial intelligence technologies and may use application programming interfaces (APIs), cloud services, data processing tools, analysis engines, rating computation models, and/or services of local and international third-party providers, including AI providers (hereinafter: "Service Providers"). During use of the service, the information entered by the user, match history, results, ratings, location (if consent was given), correspondence, and information required for calculating the player's rating, providing recommendations, matching players, operating the service, and/or any other need related to providing the service, may be automatically transferred to servers and/or systems of the Service Providers for processing, storage, analysis, output generation, and maintenance of the service. The use of the service constitutes consent to such transfer and processing, subject to applicable law. The user acknowledges that they are aware that some of the Service Providers, including AI providers, may use the information, content, match history, results, and data transferred to them for the purpose of providing the service, quality control, security, maintenance, improving their services and/or training and improving their models and systems (including player rating models), subject to their policies and applicable law. In addition, the Operator may use said information for the purpose of improving, training, and refining the service, systems, algorithms, and models, all subject to applicable law. Therefore, it is recommended not to upload sensitive, confidential, intimate, or any other information to the service that the user does not wish to be processed within the service. The Operator uses, to the extent possible, services, interfaces, and providers operating at accepted standards of information security. However, since some of the information is processed and/or stored on systems and servers not under the Operator's control, including outside of India, absolute immunity from exposure, unauthorized access, or security risks at such providers cannot be guaranteed. The Operator may collect location data from the user's mobile device, provided the user has given explicit consent. Location data is used for the purpose of finding padel courts near the user's location, court recommendations, improving the user experience, and displaying relevant content. The user may revoke the location permission at any time through the device or application settings. In the event that the user participates in chats and communities within the platform, the content of conversations, messages, and correspondence may be stored in the Operator's systems for documentation, monitoring, security, and enforcement of the Terms of Use. The Operator takes reasonable security measures to protect the privacy of conversations, including encryption of communications, but cannot guarantee absolute protection. It shall be clarified that chats may be encrypted at the transport layer (Transport Layer Encryption) but are not necessarily end-to-end encrypted (End-to-End Encryption), unless stated otherwise. It is recommended not to share sensitive personal information in chats or communities. User Choices Regarding Information Collection and Use The user may choose not to provide the Operator with certain information; however, this will result in the inability to use certain features of the website, as such information is required in order to use the Operator's services, including court reservations, tournament registrations, rating calculation, match coordination, and access to chats and communities. When the user registered for the service and approved receiving direct mailings, the Operator shall be entitled, subject to applicable law, to send direct mailings, email messages, text messages, system notifications, service notifications, tournament updates, invitations to padel events, alerts, surveys, marketing content, service updates, information regarding courts, products, benefits, and special offers. If the Operator has already disclosed information about the user to a third party lawfully before the user changed their preferences or updated their information, the user may need to update their preferences directly with such third party, as applicable. Chats, Communities, and Correspondence The platform may offer direct chat services between users, groups, and/or communities for padel players. The Operator does not actively monitor the content of conversations in chats and communities, and does not review, filter, or verify the content uploaded by users. The responsibility for chat content lies solely with the users. The Operator takes reasonable security measures to protect the privacy of conversations, including encryption of communications between users. However, the Operator cannot guarantee absolute protection against unauthorized access or information leakage. It shall be clarified that chats may be encrypted at the transport layer (Transport Layer Encryption) but are not necessarily end-to-end encrypted (End-to-End Encryption), unless stated otherwise. The Operator may remove offensive, inciting, degrading, or legally violating content at its sole discretion and without prior notice. The Operator may block a user from access to chats and communities without prior notice. The Operator is not responsible for any damage arising from content published by users in chats and communities, including defamation, fraud, deception, emotional harm, or any other damage. It is recommended not to share sensitive personal information (such as ID numbers, credit card details, full home addresses, etc.) in chats or communities. Court Owners and Information Disclosure The Operator may transfer to padel court owners information necessary for providing the service, including details of the user who reserved the court (name, phone, email), booking details, dates, payment details, and previous booking history, as necessary for confirming the booking, operating the court, and providing the service to the user. Court owners undertake to maintain the confidentiality of the information provided to them and to use it solely for the purpose of providing the service to the user. The Operator is not responsible for the use made by court owners of the information provided to them, and the user agrees that the disclosure of information to court owners is necessary for providing the service. Use of Information Collection Technologies The Operator may use various technologies to collect information from the user's mobile device and/or computer and about the user's activity on the website and/or in the application, including Cookies, SDKs, web beacons, pixels, log files, device identifiers, and similar technological means. The Operator may automatically collect information from the mobile device, operating system, application, or browser of the user when they visit the website and/or use the application. Such information may include, among others, IP address, device type, browser type, browser language, access times, device identifiers, system data, communication provider, usage data, crash data, location data (if consent was given), content of Cookies that have not been deleted, and the referring website address. Information Security The Operator implements accepted and up-to-date information security systems and procedures on the website and/or the application, the purpose of which is to reduce the risks of unauthorized access, prohibited use, loss of information, or infringement of user privacy. However, these systems and procedures do not provide absolute security, and the Operator does not guarantee that its services, systems, or databases will be absolutely immune from unauthorized access, leakage, loss, or disruption of information. The Operator reviews from time to time the information security measures of the website and/or the application and makes changes, adjustments, and upgrades as necessary, in order to maintain a reasonable and appropriate level of information security. However, the Operator shall not be liable for any damage, direct or indirect, caused to the user in the event of information exposure, loss, or unauthorized use thereof, as a result of unauthorized access by third parties, cyber events, malfunctions beyond the Operator's control, or as a result of any act or omission beyond its reasonable control. Right to Access and Update Information Under the Privacy Protection Act, 5741-1981, every person has the right to review the information held about them in the Operator's database. A user who has reviewed their information and found that it is inaccurate, incomplete, unclear, or outdated, may contact the database owner with a request to correct and/or update and/or delete the information held about them as stated above. Such requests may be directed to the Operator by email at: ________________. It is hereby clarified that there may be changes in the contact details and in the Operator's availability times at its discretion, and without prior notice, and the user shall have no claims against it in this regard. If the information in the Operator's database is used for the purpose of personally contacting the user, they may, subject to applicable law, demand in writing that the information relating to them be deleted from the database and/or that its use for direct mailing purposes be discontinued. Changes to the Privacy Policy The Operator may change the provisions of this Privacy Policy from time to time, including to reflect changes in the service, in the Operator's activities, in legal requirements, or in the manner of processing information. If material changes are made to the provisions concerning the use of personal information provided by the user, a notice will be published on the website and/or in the application, at the Operator's discretion and subject to applicable law.
